U.S. Chamber urges Supreme Court to review RICO judgment against tobacco companies
March 22, 2010
NCLC urged the Supreme Court to review whether the RICO judgment against various tobacco companies is valid. The DC Circuit ruled that Philip Morris and others violated RICO by allegedly deceiving the American public about the health effects and addictiveness of smoking cigarettes. In its brief, NCLC argued that the DC Circuit incorrectly interpreted RICO and improperly expanded the statute's intended meaning. NCLC warned that the decision also hampers the ability of businesses to participate freely in public debates on matters critical to the economy.
