The U.S. Chamber filed an amicus brief urging full Ninth Circuit to rehear case and overturn panel holding that the Federal Arbitration Act’s exemption for transportation workers “engaged in interstate commerce” covers drivers that complete the final leg of an interstate delivery but do not cross state lines. The U.S. Chamber previously filed an amicus brief at the merits stage.

U.S. Chamber files amicus brief concerning transportation-worker excemption in Section 1 of the Federal Arbitration Act

The brief argued that the District Court erred in construing the scope of “workers engaged … in interstate commerce” phrase to limit the availability of arbitration to resolve work-related disputes.
