U.S. Chamber urges Supreme Court to review state laws precluding arbitration

NCLC asked the U.S. Supreme Court to hold that the Federal Arbitration Act preempts Illinois statutes that implicitly preclude arbitration on vague “public policy” grounds. By refusing to enforce arbitration agreements based on subjective and easy to manipulate doctrines like “public policy” and “unconscionability,” rogue state courts are undermining federal law and policy favoring arbitration.
