Ninth Circuit rehears decision that permitted a CAFA loophole
November 18, 2014
The panel reversed the district court's orders which allowed case to be remanded to state court. The en banc court held that CAFA’s “to be tried jointly” requirement was satisfied when plaintiffs moved for pretrial consolidation of 26 state-court cases in CA state court.
