Supreme Court remands case to Tenth Circuit

The case is remanded to the Tenth Circuit for further consideration in light of BP p.l.c. v. Mayor and City Council of Baltimore, 593 U. S. ___ (2021).
Tenth Circuit holds that the Federal Officer Removal statute only authorizes appellate review of “federal officer” grounds for removal, not entire remand orders, and rejects federal subject matter jurisdiction over nuisance claims
