U.S. Chamber files amicus brief on constitutionality of Regional Greenhouse Gas Initiative

NCLC urged the New York Supreme Court to hold that the Regional Greenhouse Gas Initiative (RGGI) violates the U.S. Constitution and also violates New York law because it is a tax established by the executive, not legislative, branch. According to NCLC, climate change is a global issue that cannot be solved by a regional cap-and-trade regime, which would impose considerable costs on companies but would have no discernible impact on global greenhouse gas levels.
