U.S. Chamber files amicus letter regarding punitive damages for alleged wage and hour violations

NCLC urged the California Supreme Court to reject a request by a class of plaintiffs in the Savaglio v. Wal-Mart case to depublish an earlier unrelated appellate court decision, Brewer v. Premier Golf Properties, holding that plaintiffs may not recover punitive damages for claims based solely on meal period, rest break, pay stub, or minimum wage violations. According to NCLC, the appellate’s decision correctly interpreted California law, and explained to the Court that no other state expressly authorizes punitive damages for wage and hour cases.
