U.S. Chamber files amicus brief regarding regulatory actions requiring payment of money as takings violations

The U.S. Chamber urged the Supreme Court to review a ruling by the Illinois Supreme Court holding that the Takings Clause applies only to the state’s exercise of eminent domain, and that regulatory actions requiring the payment of money are not takings. The Chamber argued that the ruling is inconsistent with the U.S. Supreme Court’s takings jurisprudence, and is inconsistent with the broad meaning of “private property” intended by the Framers.
