NCLC urged a Michigan appeals court to reverse the judgment against employers in an asbestos case. In this case, the lower court defied a Michigan Supreme Court “anti-bundling” order by “bundling” legitimate asbestos claims of plaintiffs with malignant tumors with frivolous claims by non-impaired claimants. NCLC argued in its brief that asbestos cases should be considered on an individualized basis, and priority should be given to the sickest plaintiffs' cases. NCLC warned that the lower court’s order bundling the cases unfairly pressures employers to settle the frivolous claims bundled with the legitimate claims.
