U.S. Chamber urges California Supreme Court to review decision that effectively adopts “any exposure” theory of liability for asbestos-related claims

The U.S. Chamber urged the California Supreme Court to grant review of this case because it raises important questions of statewide concern warranting the court's review. The Chamber pointed out that various divisions and districts of the Court of Appeal, and numerous trial courts in the state have overstepped and failed to faithfully apply the California Supreme Court's binding precedent by broadening the liability standard for asbestos-related claims to what has effectively become an "any exposure" theory of liability. Additionally, the Chamber warned that this change threatens to make the California court system a magnet jurisdiction for asbestos cases, even cases where neither the plaintiff nor the defendant are located in the state.
