NCLC files amicus brief addressing scope of appellate review of punitive damages awards in state courts

The Pennsylvania Supreme Court granted review to consider whether conduct of a party during a bad faith insurance action is admissible to support a punitive damages award and what scope of review an appellate court should apply when reviewing a punitive damages award. NCLC argued that that alleged misconduct during the litigation itself should not support a bad faith insurance claim for punitive damages and that Pennsylvania should employ the searching review of punitive damages awards required by the Supreme Court’s decision in Cooper Industries v. Leatherman Tool Group.
