U.S. Chamber urges California Supreme Court to limit Unfair Competition Law

The U.S. Chamber filed a request for depublication asking the California Supreme Court to depublish an appellate court decision holding that a private plaintiff had standing to pursue an Unfair Competition Law (UCL) claim under the theory that the private plaintiff, the Animal Legal Defense Fund, had expended resources to investigate whether a restaurant had violated a state ban on the sale of foie gras. The Chamber argued that such an expansive definition of “injury” would open the floodgates to UCL litigation, in contravention of Proposition 64, which California voters passed to limit “no injury” UCL lawsuits.
