U.S. Chamber argues courts must act as gatekeepers in litigation process
May 09, 2013
NCLC urged the Maryland Court of Appeals to affirm the Court of Special Appeals' opinion rejecting the plaintiffs' expert testimony. NCLC argued that courts must act as gatekeepers to protect the litigation process from disingenuous testimony and untested theories. NCLC argued that the approach used by the plaintiffs' expert witness in this case is not sound nor does it satisfy the standards required by Maryland law. NCLC also urged the court to use this appeal to strengthen the rejection of expert testimony like the one in this case and redirect Maryland trial courts and the court of special appeals to vigorously apply Maryland's standards for expert and opinion testimony.
