NCLC filed an amicus brief urging the Court of Appeals of Arkansas to uphold as constitutional the punitive damages cap enacted by the state legislature. Not only does a cap on punitive damages comport with the Arkansas constitution, it is also a sound policy decision to ensure fair treatment of defendants in the court system.
