President Trump on June 19 announced his intent to nominate Marvin Kaplan of the Occupational Safety and Health Review Commission to serve as a member of the National Labor Relations Board (NLRB), making him the second Republican on the five-seat board.
As this blog has written repeatedly, the NLRB currently has a 2-1 Democrat majority left over from the Obama administration. Until the U.S. Senate confirms Kaplan, Republican Chairman Phil Miscimarra can still be outvoted in NLRB decisions. Given that the NLRB engaged in massive overreach during the previous administration, the business community is eager to see balance restored to the agency.
In addition, President Trump announced his intent to nominate Patrick Pizzella to serve as Deputy Secretary at the U.S. Department of Labor (DOL). Mr. Pizzella is currently the acting chairman of the Federal Labor Relations Authority, and he previously served as the Assistant Secretary for Administration and Management at DOL during the administration of President George W. Bush.
Hopefully, the Senate will act swiftly on these nominations to restore balance and common sense to the NLRB and DOL.
